At TAK Pharma we are committed to protecting your privacy and your personal data. We process personal data following applicable regulations, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (the “GDPR”).

PURPOSES AND LEGAL BASIS FOR PROCESSING

We may process your personal data for the following purposes:

  1. conducting correspondence with you, archiving it, or handling complaints, i.e., under Article 6 (1) (f) of the GDPR (processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data). On this basis, we may process personal data provided by you in your correspondence addressed to us, such as name, last name, email address, or phone number, which will be proceeded until the need to contact you ceases, no longer than for three months since the contact ended;
  • negotiation and implementation of contracts, i.e., under Article 6 (1) (b) of the GDPR (processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract) or Article 6 (1) (f) of the GDPR (processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data). On this basis, we process personal data provided by you during negotiations or performance of the contract concluded with TAK Pharma (Article 6 (1) (b) of the GDPR) or data that has been provided to us by our client or contractor, on whose behalf you are acting or whom you represent (Article 6 (1) (f) of the GDPR). We process such data for the duration of the contract, and after its execution, when required by law, for 5 years (from the end of the year) (Article 74 of the Polish Accounting Act as of September 29, 1994) or until the limitation of possible claims or effective objection;
  • recruitment for work, i.e., under Article 6 (1) (b) of the GDPR (processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract). On this basis, we process your name(s) and last name(s), date of birth, contact details, education, professional qualifications, and information on previous employment. We process other data contained in the application based on your consent (Article 6 (1) (a) of GDPR). With your consent, we also process this data for future recruitment. We process such data until the recruitment is completed, no longer than for 6 months, and in the case of consent to the processing of data also for future recruitment, until the consent is revoked.

In all other cases, i.e., when personal data is collected for a different purpose or on a different basis, we provide information on the rules and conditions of the processing in the relevant information clause, which is provided when collecting such data.

RULES OF DATA PROCESSING AND PROFILING

We keep personal data confidential and secure against unauthorized access by third parties following rules specified in applicable regulations, including the GDPR.

Your personal data will not be used for automated decision-making, and no profiling will be made based on your personal data.

TRANSMISSION OF PERSONAL DATA

Your personal data may be transferred to:

  1. employees and associates of TAK Pharma, that is to people with whom TAK Pharma cooperates in business activity, as well as third-party service providers whose services are used by TAK Pharma when processing your personal data, e.g., IT service providers;
  2. entities processing personal data on behalf of TAK Pharma under the data processing agreement;
  3. regulatory bodies or entities entitled to access processed personal data under separate legal provisions.

Your personal data may be transferred to entities, whose services we use, and whose principal offices are located outside the European Economic Area (“EEA”). Such countries may not ensure an adequate level of protection as required in EEA.

We make every effort to ensure that transfer outside the EEA does not lead to a limitation of the level of protection granted by the GDPR. Therefore, your personal data may only be transferred to third countries or entities for which a decision confirming adequate data protection has been issued by the European Commission. If no relevant decision has been issued for a third country, personal data may be transferred to that country based on binding corporate rules, standard data protection clauses adopted by the European Commission, standard data protection clauses adopted by the Polish supervisory authority and approved by the European Commission, approved code of conduct or approved certification mechanism. In the absence of adequate security measures in the country to which the data is to be transferred, the transfer of data will be based on your consent. Before giving your consent, you will be informed of the risks related to such a transfer.

YOUR RIGHTS RELATED TO THE PROCESSING

With the processing of personal data, you have the following rights:

  1. right to access to your personal data, to the rectification of any information you believe, is inaccurate (correction), to the completion of the information you believe is incomplete, to the erasure and the restriction of processing of your personal data, to data portability, as well as the right to obtain a copy of your data;
  2. right to object to the processing of your personal data;
  3. if you believe that processing of your data violates legal provisions you are entitled to complain to the competent authority, that is President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warszawa);
  4. where the processing is based on your consent, the right to withdraw consent at any time (the withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal).

You do not have to provide us with your data. However, if you refuse to provide them, we may not be able to provide you with certain services.
